These terms and conditions govern your access and use to our website (Bouldy Home Nursery) and related services including ordering, purchase and delivery of items from our website. The website and all contents on the website are owned by Bouldy Home Nursery Pty Ltd ACN 28 855 262 044 (‘Bouldy Home Nursery’ we, us and our).

These terms and conditions are to be read in conjunction with any additional Terms and Conditions or policies we provide (referred to as ‘Terms’). Including but not limited to our Privacy Policy, Data Security Policy, Refunds/Cancellations policy, Products policy, Postage and Handling policy, Site Access policy, Products Policy, Intellectual Property Policy and item descriptions. To the extent of any inconsistencies, the provisions of these Terms and Conditions apply.

By accessing or using our Website, you warrant and represent to us that you have read, understand and agree to be bound by these terms and conditions and that you are over the age of 18 years and you have the right, authority and legal capacity to enter into a legally binding agreement to abide by these terms and conditions.

Consumer Rights – This policy supplements your rights under Australian Consumer Law and does not limit or override those rights.

Consumer Protection Law – Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability – Bouldy Home Nursery and our directors, offers, agents, employees, subsidiaries and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity – Except where permitted by law, by using this Site you indemnify and hold harmless Bouldy Home Nursery and our directors, officers, agents, employees, and affiliates from any action, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site and your violation of these Terms and Conditions.

Severability – If at any time of the provision set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Applicable Law – These Terms and Conditions are governed by the laws of the State of Queensland.

Privacy Policy

Bouldy Home Nursery is committed to protecting your privacy, we uphold your rights to privacy protection under the National Privacy Principles contained in the Privacy Act 1988 (Cth). Personal information held by Bouldy Home Nursery may include your name, address, billing address, shipping address, email address and telephone number. We collect your personal information to deliver our products to you. Bouldy Home Nursery will only disclose personal information about you.

• In accordance with the law
• As authorised by you in our contract with you; and/or
• With your direct consent.

Data Security Policy

Safeguarding your personal information is important to us, and we have taken all reasonable steps to protect it from misuse, loss and unauthorised access. We do not collect or store any of your financial information. We offer the option to pay by Credit Card or Direct Debit (EFT), through your internet banking for you to pay for your online purchases. Although we have implemented security measures concerning your personal information, as the internet is inherently insecure, Bouldy Home Nursery cannot provide any absolute assurance regarding the security of any online transaction.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

Disclaimer – We may update this website privacy policy or Terms and Conditions from time to time, including to reflect changes to our practices or for other operation, legal or regulatory reasons. We will post the revised Privacy Policy on this website, update the “Last updated” date and provide notice as required by applicable law.

Refunds/Cancellations Policy

• Refund policy – We offer a 48-hour refund policy from when you receive your parcel. To qualify please send photographs (whole plant photos and photos of the problem) to be emailed to amy@bouldyhomenursery.com.au quoting your invoice reference number within 48 hours of receiving your plant(s). Refund is at the discretion of the owner. We shall except no responsibility for any damage that may be caused by Australia Post handling of our parcels. We take care in the packaging and handling of all plants prior to shipment from Australia Post.
• We don’t have a cancellation policy. Once items have been ordered and paid for, we are unable to refund you for change of mind so please choose carefully when ordering and proceeding to payment.
• We do not process refund enquiries through any of our social media accounts. It is directly through our email; amybouldyhomenursery.com.au

Postage and Handling Policy

• Please note – If you have placed a “PICK UP ONLY” product into your cart – ALL ITEMS in your cart will then be marked to as “PICK UP” and are to be collected directly from the nursery. If you wish for some products to be posted and some to be ‘click and collect’, please place 2 separate orders.
• Postage only to non-restricted states (QLD, NSW, VIC, ACT & SA). If you’d like to enquire about a concierge service for postage to TAS, WA and NT. Please send us an email and see our Concierge Service information. We have included more information regarding posting costs in the Shipping Information.
• Postage is mailed express every Monday excluding public holidays. Once an order is placed it will be shipped the following Monday. Cut off for Monday’s orders each week is Saturday 12 noon QLD time. Orders placed after 12 noon Saturdays will be shipped the Monday of the following week. In the event of a public holiday on the Monday, items will be shipped express on Tuesday.
• We only offer express postage on all items. This ensures the fastest delivery method with tracking. We use Express No Extras option which is No signature on delivery. If you would like to use signature on arrival, please specify this in our add note section provided in the checkout section.
• Any specific delivery instructions you wish for us to abide by must be noted in the add note section provided at the checkout.
• Whist we take the utmost care when packing and handling items some varieties of plants are very delicate. There may be slight imperfections which are out of our control with even the care fullest of packing. Refunds will not be eligible on delicate items with imperfections. Plants that are delicate will have a delicate symbol attached to the plant’s profile. So please note this when ordering.
  
• It is the buyer’s responsibility to ensure correct delivery address has been supplied and that parcels can be delivered to the supplied address. We accept no responsibility if Australia Post incorrectly delivered parcels to the wrong address. These matters will need to be taken to Australia Post.
• Any damage to parcels from Australia Post delivery are to be resolved directly with Australia Post, Bouldy Home Nursery will not be liable for these issues. If your post doesn’t arrive please contact us directly and we’ll help to resolve these issues where we can however if parcel has been lost by Australia Post, we are not liable for the lost products.
• Please remember plants can go through a transplant shock phase after arrival. Some plants can have yellowing leaves/leaf drop especially if your climate is quite different to ours here at the nursery so, please bare this in mind. 

Products Policy

• Our whole nursery is watered by bore water only as such plants can/may have white limescale marks on the leaves/stems. Refunds won’t be given for plants that may have such marks. Unfortunately, this is out of our control.
• Some products are only available for pick up due to the size, weight or difficulty in packing bare root. This will be specified in the description and ordering section.
• Most of our plants are hard grown in Central Queensland weather as such plants can have marks/scars/corking due to being grown in these elements. Plants in this category will have comments mentioned in our special notes section in the plant descriptions. Please take note of these such comments. No refunds will be offered for plants that have this special notation highlighted and may have such appearance as mentioned above (marks/scars/corking).
• This website is intended for Australian residents only.
• All plants are sent bare root (No soil). We also do not wash the soil off our root systems as we find it is time consuming and deem this an unnecessary step. If you would like the roots washed and dried, you’ll need to specify this in our add notes section at the checkout.
• Pick up items can only be collected during our open hours. So please note our opening hours.
• All plants are subject to availability we cannot guarantee that items will be in stock at all times. If an item was in stock but has become unavailable due to other customer’s purchases, we will notify you via email and offer you a substitute. If we don’t hear from you in regard to the substitute, that substitute shall be sent out. We reserve the right to discontinue any product at any time for any reason. Prices are subject to change and are current at the time of purchase on the website. No price change refund is available if pricing online changes.
• Sometimes stock may not pass our quality standards when it comes time to pack. If this occurs, you’ll be notified via email. You’ll then be offered a refund of the price of that individual plant only. Postage may have been combined with several items purchased therefore we are unable to offer any refund regarding postage UNLESS it was the one item only ordered; in that case we’ll offer you a full refund with postage refunded also.
• Plants in the photo to buy are a reference to the size and type of plant you’ll be ordering. You will not be receiving that exact plant from the reference photo. At times whilst we try to match the plant to the photo used when ordering at times plants may have a different shape, colour and size to the reference photo. We do not offer refunds if the product does not exactly match our website catalogue picture. We do try to select the best version possible at the time of packing orders.
• We make every effort to correctly label all our plants by the correct species name we may on occasion have something incorrectly labelled. Please note this is never intentional. Refunds are not given due to incorrect labelling. We label plants as the name given to us from our supplier. Sports and mutations may have occurred which is out of our control. 
• We will not be held responsible for any pest infection or failed plant care after plants have left the nursery. We will not be held liable for the presence of any soil, insecticide, pesticides or fertiliser that remains on the product when shipped to you.
• We do not offer refunds after the 48-hour period under any circumstance.
• We reserve the right to refuse Service to anyone for any reason at any time.
• Prices for our products are subject to change without notice.
• Care should be taken when handling plants on arrival, we recommend wearing protective clothing such as gloves and a mask when handling plants & soil. We will not be held liable to you or any other person for injury or damage (whether indirect, direct, consequential or economic) sustained by the misuse or mishandling of any part of the product. No part of any product is edible.
• We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and you have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
• By handling these plants, you assume full responsibility for any risks associated with exposure to substances arising from within any plant’s substances. We recommend you adhere to safety guidelines such as wearing protective clothing. You indemnify and hold harmless the supplier against any claims, damages or liabilities arising from improper handling or failure to adhere to safety guidelines.

Gift Cards

No Cash Redemption: Gift cards cannot be exchanged for cash. 
Partial Redemption: If a purchase is less than the card balance, the remaining balance is stored for future use. 
Insufficient Funds: If a purchase exceeds the card balance, you must pay the difference with another method. 
Lost/Stolen Cards: Bouldy Home Nursery will not be liable for any lost or stolen Gift Cards. Lost or stolen cards will not be replaced or refunded. 
Retailer Exclusions: Gift cards are restricted to be used on the bouldyhomenursery.com.au website, and are not valid for purchasing other gift cards. 
Fraud Suspicion: Bouldy Home Nursery reserve the right to cancel or place a hold on a card if they suspect fraud or illegal use. 
Expiry: Gift Card expires 3 years (1096 days) from the date of issue.

Intellectual Property Policy

• You are not permitted to copy, reproduce, republish, distribute or reuse any information on our website. This includes copyright of all our photos, album covers photos, text, logo, graphs, plant descriptions, website layout and design ideas for repurpose without prior written consent as these are owned and controlled by us (Bouldy Home Nursery owners) and are protected by copyright and trademark laws and various other intellectual property rights.
